Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of SACA and its licensors.

Our Service may contain links to third-party web sites or services that are not owned or controlled by SACA.

SACA has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that SACA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Iceland without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Pricing and Terms of Payment

All of our prices are in Icelandic Krona (ISK) as listed on our website, https://saca.is. Our prices include VAT and taxes. The Product and our service are prepaid. Upon a payment, the Purchaser will receive from us an order confirmation and a receipt of a payment sent according to given contact information by the Purchaser. SACA accepts cards from Mastercard, American Express, VISA, JCB, Diners Club and CUP.

Cancellation

In cases where the Purchaser wishes to make a cancellation regarding his order:

Bjarnarey Puffin Island:

The Company keeps the fee of 100.0% if cancelled 7 day(s) before event or less.

The Company keeps the fee of 10.0% if cancelled 15 day(s) before event or less.

The Company keeps the fee of 5.0% if cancelled 30 day(s) before event or less.

Elephant Rock:

The Company keeps the fee of 100.0% if cancelled 2 day(s) before event or less.

The Company keeps the fee of 20.0% if cancelled 7 day(s) before event or less.

1-hour RIB Boat Tour:

Cancellation fee of 100% is charged if cancelled 1 day or less before the event

Cancellation fee of 50% is charged if cancelled 3 days or less before the event

Cancellation fee of 20% is charged if cancelled 7 days or less before the event

Cancellation fee of 0% is charged if cancelled 31 days or less before the event

The cancellation must be sent via e-mail to haraldur@saca.is. Refund can take up to 10 business days to show on the Purchaser’s bank account.

Safety Rules, Responsibility of Participants etc.

Regarding hiking tours:

Advanced hikers only! Due to the nature of The Product, anyone afraid of heights is advised to reconsider booking our tours. The age limit for our tours is 15 years old. Due to possible damage to unborn children and the woman herself in case of an accident, pregnant women are not permitted to join the tours. People under the influence of alcohol or intoxicating drugs are not permitted on the tours. Please note that the weight limit for all tours is 120 kg (265 lbs).

Regarding boat tours:

Pregnant women and individuals with back problems are discouraged from booking a boat tour.

Product Disclaimer

Our tours are weather and condition dependent. In cases of bad conditions, we reserve the right to cancel a tour moments before departure. In cases where we cancel the “Bjarnarey Puffin Island” tour, we will offer the Purchaser a plan B trip which is a package consisting of the tour “Elephant Rock”. Due to lower price of the plan B trip, the Purchaser will be reimbursed the difference.

SACA reserves the rights to alter routes, tours or timetables without prior notice, should the necessity arise. For that reason the Purchaser is aware of and agrees that the estimated duration of tours as indicated by us can change for various reasons depending on the conditions and circumstances each time.

Liability

No responsibility is accepted for losses, expenses due to delays, changes of flights, closed roads or other services or because of strikes, accidents, sickness, damage, negligence, weather, war, changes in bus schedules, or other similar causes. The Company does not assume responsibility for accidents or death that can be traced to the participant’s negligence, acts of third parties or exterior circumstances such as weather, natural occurrences, war or other similar causes.

Insurance

The Company advises all its clients to have insurance.
